 淺談法律翻譯中“依法”一詞的規(guī)范英文譯法

“依法”一詞，作為法律翻譯中常見高頻詞匯，常見于合同、合作協(xié)議書等文件的翻譯中。由此衍生的高頻詞語(yǔ)也有很多，如依照法律法規(guī)、依據(jù)某條法律等等。那么“依法”一詞怎么翻譯才更加規(guī)范，更加符合法律文件準(zhǔn)確性、專業(yè)性、公正性的特點(diǎn)呢？

我們?nèi)粘３Ｓ谩耙婪ā币辉~的翻譯有“in accordance with the law”、 “according to the law”、“according to law”、“by operation of law”、“On the basis of law”、“by law”等。誠(chéng)然，這些翻譯應(yīng)用于普通的翻譯中都是正確的，但針對(duì)一些專業(yè)性較強(qiáng)，翻譯質(zhì)量要求較高的文件來(lái)說(shuō)，哪種翻法更好呢？

要先說(shuō)明一點(diǎn)是，無(wú)論用哪種翻法，都要注重細(xì)節(jié)的處理，如定冠詞“the”， 切不可放錯(cuò)位置，把各種翻法弄混，出現(xiàn)“In accordance with law”或“on the basis of the law”等錯(cuò)誤。

綜上，結(jié)合準(zhǔn)確率較高的翻譯軟件以及中國(guó)翻譯協(xié)會(huì)的翻譯，考慮到專業(yè)性、準(zhǔn)確性、權(quán)威性等特點(diǎn)，“依法”一詞用“in accordance with the law”或“on the basis of law”的譯法為首選，“according to (the ) law”次之。
